Conveyancing - Important Step of The Property Transfer

Conveyancing is the branch of law that is concerned with preparation of the documents pertaining to Conveyance. This term normally comes to our ears when we are in the process of buying or selling the house. This is a legal term which refers to the reassign of the legal title of a real property from one entity to another. A mortgage can also be transferred in this behavior.  It is helpful to work with a local real estate agent who is equally familiar about these issues related to the real estate sector. Many real estate agents will have a working acquaintance of conveyancing if not they can help you find a qualified Conveyancer


The process of Conveyancing is simple if it is carried out certified clued-up conveyancer but it would turn hefty if the conveyancer is not good, so it is very important to hire a professional person to carry out your Conveyancing process smoothly. The whole process of Conveyancing takes around 4 to 12 weeks depending on the readiness of the papers that are needed during the entire process. Conveyancers are suitable for straightforward cases or for those, who have a restricted budget. Conveyancing normally involves the exchange of the contract of sale and the settlement process of the contract of sale.

Contract of sale

Contract of sale is signed by the buyer and the seller both. This document has all the details agreed upon during the treaty and also includes any special conditions mentioned at the time of agreement between the two parties.  Most of the time, the real estate agent that works on behalf of the seller will organize the final Contract of Sale. 

Statement of the buyer

This is the detailed statement that is prepared by the conveyancer/solicitor and this document is also signed by the buyer and the seller both. Planning and necessary searches are carried out by the hired professionals and seller is expected to pay the amount incurred during the search.

Transfer of land

This is one of the important documents that mention the transfer of the property from the buyer to the seller.  It includes all the particulars required and also the ownership of the property. These three documentations are important in any transaction of Conveyancing. The process can be carried out by anyone but since it involved many legal jargons, which might be difficult to understand by a normal person.

Conveyancing is a huge term if taken seriously, since it is the base on which the entire trasaction of the property whether buy or sale is done. A normal loop will stop the process of the buy or sale, so it is necessary to get it done with the help of the conveyancer who is educated and well acknowledged with the terminology and the procedure. All conveyancers are not equal so it is recommended to choose the right one and get the process done. Calling and talking to various conveyancers and then taking a call for the right one would serve the purpose.
